Section 28P

s.28P(1)

Without reasonable excuse, contravening section 28E(1) of the Wildlife and Countryside Act 1981 (duties of owners and occupiers of land in relation to SSSIs).

s.28P(2)(a)

Being an authority acting in the exercise of its functions under section 28G of the Wildlife and Countryside Act 1981 and carrying out an operation which damages any of the flora, fauna or geological or physiographical features by reason of which a SSSI is of special interest without first complying with section 28H(1), unless there was a reasonable excuse for carrying out the operation without complying

s.28P(2)(b)

Being an authority acting in the exercise of its functions under section 28G of the Wildlife and Countryside Act 1981 and carrying out an operation which damages any of the flora, fauna or geological or physiographical features by reason of which a SSSI is of special interest (if it has complied with section 28H(1)) without first complying with section 28H(4)(a), unless there was a reasonable excuse for carrying out the operation without complying.

Being an authority acting in the exercise of its functions under section 28G of the Wildlife and Countryside Act 1981 and, having complied with section 28H(1), failing without reasonable excuse to comply with section 28H(4)(b)

s.28P(4)

Being an authority acting in the exercise of its functions under section 28G of the Wildlife and Countryside Act 1981 and permitting the carrying out of an operation which damages any of the flora, fauna or geological or physiographical features by reason of which a SSSI is of special interest without first complying with section 28I(2), unless there was a reasonable excuse for permitting the carrying out of the operation without complying

s.28P(5A)(b)

Being an authority acting in the exercise of its functions under section 28G of the Wildlife and Countryside Act 1981 and permitting the carrying out of an operation which damages any of the flora, fauna or geological or physiographical features by reason of which a SSSI of special interest without first complying with section 28I(4), unless there was a reasonable excuse for permitting the carrying out of the operation without complying.

s.28P(5A)(b)

Being an authority acting in the exercise of its functions under section 28G of the Wildlife and Countryside Act 1981 and permitting the carrying out of an operation which damages any of the flora, fauna or geological or physiographical features by reason of which a SSSI of special interest without first complying with section 28I(6), unless there was a reasonable excuse for permitting the carrying out of the operation without complying.

s.28P(6)

Being a person other than an authority acting in the exercise of its functions under section 28G of the Wildlife and Countryside Act 1981, without reasonable excuse, intentionally or recklessly destroying or damaging any of the flora, fauna, or geological or physiographical features by reason of which land is of special interest, knowing that what was destroyed or damaged was within a SSSI.

s.28P(6)

Being a person other than an authority acting in the exercise of its functions under section 28G of the Wildlife and Countryside Act 1981, without reasonable excuse, intentionally or recklessly disturbing any fauna by reason of which land is of special interest a special interest, knowing that what was disturbed was within a SSSI.

s.28P(6A)(a)

Being a person other than an authority acting in the exercise of its functions under section 28G of the Wildlife and Countryside Act 1981, without reasonable excuse, intentionally or recklessly destroying or damaging any of the flora, fauna, or geological or physiographical features by reason of which a SSSI is of special interest.

s.28P(6A)(b)

Being a person other than an authority acting in the exercise of its functions under section 28G of the Wildlife and Countryside Act 1981, without reasonable excuse intentionally or recklessly disturbing any of the fauna by reason of which a SSSI is of special interest those fauna.

Section 28Q

Summary only offence.

  1. As owner of land included in a SSSI, disposing of an interest in the land and failing without reasonable excuse to send a notice to the Countryside Council for Wales before the end of the period of 28 days beginning with the date on which he disposed of the interest.
  2. As owner of land included in a SSSI, becoming aware that it is occupied by an additional or a different occupier and failing without reasonable excuse to send a notice to the Countryside Council for Wales before the end of the period of 28 days beginning with the date on which he became aware of the change in occupation.

Section 28S

Without reasonable excuse, intentionally or recklessly taking down, damaging, destroying or obscuring a notice or sign put up under 28S(1) of the Wildlife and Countryside Act 1981 (notices and signs relating to SSSIs).

Section 31(5)

Being the person against whom a Restoration Order was made under section 3 of the Wildlife and Countryside Act 1981, failing without reasonable excuse to comply with it within the specified period

Failing to comply with a requirement of a species control order
